LEGAL WARRANTY

Instructions for using the products:

- do not wash - professional dry cleaning only;

- it is strictly forbidden to wet the accessories on the garment with water, of any origin, or with any kind of substance in liquid form;

- bleaching is not allowed;

- do not dry in the tumble dryer;

- do not step on;

- do not expose to extreme environmental factors, such as: sun or sources of excessive heat, excessive humidity, rain, snow, or high wind;

- do not subject the fabric to excessive wear or repeated exaggerated movements on the surface of the material.

Failure to follow any instruction will void the warranty.

General conditions for granting the warranty:

Our company, as a seller, ensures the quality of the purchased products. The commercial warranty period for clothing and accessories sold by our company is 30 days from the date of product purchase. Under normal conditions of use, these products are guaranteed for any manufacturing defect for a period equal to the average duration of use of 60 days from the date of purchase, in compliance with the product usage rules.

This commercial warranty certificate is drawn up and issued in accordance with the provisions of Law no. 449/2003 regarding the sale of products and their associated guarantees, republished and amended by OG no. 9/2016 and OG no. 21/1992, on consumer protection, republished and amended.

The rights provided by consumer law (including the legal guarantee of conformity provided by art. 2 par. e¹ in conjunction with art. 16 and 16² of Law no. 449/2003) are not affected by the commercial warranty offered. Hereby, consumers are directly informed that the average duration of use of the product is 60 days from purchase, in which case the legal guarantee of conformity granted to consumers (as defined by art. 2 point 2 of OG no. 21/1992 on consumer protection) is limited to this period, in accordance with the provisions of Law no. 449/2003.

In the case of legal entity buyers, only the commercial warranty of 30 days from purchase is applicable.

In order to grant the commercial warranty and, respectively, the legal guarantee of conformity, strict compliance with the instructions specified above is necessary. You must consider that with time and wear, all products will show signs of wear and tear, and this does not constitute a defect that implies the granting of a commercial or legal warranty of conformity. The warranty applies only if the buyer provides proof of the purchase of the product from our company, in which case it is mandatory to present all elements present at the time of purchase. The lack of one of the elements may lead to the refusal of the warranty.

In the event of an unjustified request for the granting of the warranty, we reserve the right to ask the beneficiary for the transportation costs paid by the company for the return of the product claimed to be defective and for the labor to investigate the product claimed to be affected by hidden defects. All products claimed to be affected by hidden defects will be subject to expert examination. The warranty is valid only on the territory of Romania, exclusively for products purchased directly from our company. The warranty period is extended by the period elapsed from the date of the complaint to the date of bringing the product into compliance (including the period required for expert examination), mentioning this fact in the warranty certificate. In case of product replacement, a new warranty certificate will be issued.

Ways of ensuring the warranty:

In the event of a defect in the product purchased from our store during the warranty period, please contact us in writing at contact@dianavasilita.com.

The warranty will be provided in no more than 15 calendar days from the date of notification by:

• repairing the product;

• replacement of the product - if it cannot be repaired;

• refunding the value of the product, if neither repair nor replacement is possible.

The seller reserves the right to unilaterally decide on the remedial option that it considers appropriate in each individual case.

According to the provisions of Law no. 449/2003, when purchasing the product, the seller has the obligation to explain how to use and maintain the supplied product. The customer has the obligation to check the integrity of the product, the external appearance, and the presence in the packaging of the product's accessories before finalizing the sale. Any subsequent complaint regarding the lack of conformity from an aesthetic point of view or external integrity that could have been notified at the time of purchase will not be taken into account. In order to be recognized and validated, any non-conformity of the product must be reported within the warranty period.
